1. Acceptance of Terms

By accessing and using MoonPhase's lead generation services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

MoonPhase provides AI-powered lead generation services across multiple digital channels including social media platforms, search engines, and premium advertising networks. Our services are designed to identify, engage, and convert high-quality prospects for business clients.

3. Pricing and Payment Terms

MoonPhase operates on a pay-per-response pricing model:

  • Social Media Channels: $40 per replied lead
  • Search Engine Channels: $50 per replied lead
  • Premium Channels: $60 per replied lead

Payment is due within 30 days of invoice date. A "replied lead" is defined as a prospect who responds with genuine business interest through any communication channel.

4. Client Responsibilities

Clients are responsible for:

  • Providing accurate business information and target audience specifications
  • Responding to qualified leads in a timely manner
  • Maintaining compliance with all applicable laws and regulations
  • Ensuring all marketing materials and messaging comply with platform policies

5. Data Privacy and Protection

MoonPhase is committed to protecting client and prospect data. We implement industry-standard security measures and comply with applicable data protection regulations including GDPR and CCPA. Client data will not be shared with third parties without explicit consent.

6. Service Level Agreement

MoonPhase strives to maintain 99.9% uptime for our platform services. We provide 24/7 monitoring and support for all active campaigns. Response times for support inquiries are typically within 4 business hours.

7. Limitation of Liability

MoonPhase's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages arising from the use of our services.

8. Termination

Either party may terminate this agreement with 30 days written notice. Upon termination, all outstanding invoices become immediately due and payable. Client data will be securely deleted within 90 days of termination unless otherwise requested.

9. Intellectual Property

MoonPhase retains all rights to its proprietary technology, algorithms, and methodologies. Clients retain ownership of their business data and marketing materials provided to MoonPhase.

10. Modifications to Terms

MoonPhase reserves the right to modify these terms at any time. Clients will be notified of material changes via email at least 30 days prior to implementation.

11. Governing Law

These terms are governed by the laws of the State of Texas, United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
